TERMS OF SERVICE

1. Introduction These Terms of Service (“Terms”) govern your interaction with Alelegance, including
our website at https://alelegance.com, our social media channels, and our renovation services provided in the Province of Ontario. By accessing our services or engaging us for a renovation
project, you agree to be bound by these Terms.
2. Scope of Services We specialize in the installation of hardwood flooring, staircases, and related
trim work.
● Estimates: All quotes and estimates are valid for 30 days. Prices are subject to change if
material costs fluctuate significantly before the contract is signed.
● Site Assessment: An on-site assessment is required before a final price is quoted.
Estimates provided without an on-site visit are preliminary only.
● Exclusions: Unless explicitly stated in a written Contract, our services do not include: demolition of hazardous materials (asbestos, lead), structural engineering,
electrical/plumbing work, painting, providing ‘extra work’ outside the scope of the agreed upon services or moving of heavy furniture.
3. Booking and Deposits
● Reservation: To secure a start date, a deposit is required.
● Deposit Limits: In accordance with the Ontario Consumer Protection Act, deposits for home renovation contracts generally shall not exceed 10% of the total contract price unless specific
exceptions apply. We will clearly disclose the deposit amount in your Contract.
○ Exceptions: Materials must be paid before the installation date. As every project requires a special order of materials and cannot be returned/refunded, we reserve the right to collect the price of materials (e.g hardwood flooring, trims, and other
materials besides labor) before the installation, or 30%-40% of the total price of the project. We will clearly disclose the deposit amount in your Contract/Estimate
● Cancellation: If you cancel a project after the deposit is paid but before work commences, the deposit may be forfeited to cover administrative costs and reserved scheduling time. If work has commenced, you are responsible for all costs incurred up to the cancellation date.
4. Client Responsibilities To ensure a successful project, the Client agrees to:
● Access: Provide clear, unobstructed access to the work area and utilities (water, electricity).
● Preparation: Remove all personal belongings, furniture, and rugs from the work area prior to the start date.
● Environment: Maintain the home temperature between 18°C–24°C (65°F–75°F) and relative humidity between 30%–50% before, during, and after installation. Failure to do so may void manufacturer warranties.
● Pets and Children: Secure pets and children away from the work zone. We are not liable for injuries to pets or children resulting from exposure to tools, dust, or unfinished surfaces.
● Permits: The Client is responsible for obtaining any necessary municipal building permits for structural changes, unless otherwise agreed in writing.
5. Changes to Scope (Change Orders) Any changes to the original Scope of Work, materials, or timeline must be documented in a written Change Order or Estimate signed by both parties. Verbal agreements for extra work are not binding. Work will not proceed on changes until the Change Order is signed and the additional cost is agreed upon.
6. Payment Terms
● Invoicing: Invoices are issued according to the payment schedule in your Contract.
● Due Date: Payments are due within the agreed upon payment structure
● Late Fees: Late payments may incur interest at a rate of 3% per month or the maximum rate
permitted by Ontario law.
● Lien Rights: Under the Construction Act (Ontario), the Contractor retains a lien on the property until full payment is received.
7. Warranties and Limitations
● Workmanship: We warrant our installation work for 1 year against defects in workmanship.
● Materials: Materials are covered by the manufacturer’s warranty, not ours. We will facilitate warranty claims but are not liable for manufacturing defects.
● Exclusions: Warranties do not cover damage caused by improper maintenance, water
damage, humidity extremes, abuse, or normal wear and tear (e.g., scratches from pet claws or furniture).
● No Consequential Damages: To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages (e.g., loss of use of the home, temporary accommodation costs) arising from the renovation.
8. Intellectual Property All designs, plans, and photographs taken by us during the project remain our intellectual property. We reserve the right to use photos of completed projects for marketing purposes (website, social media, portfolios). If you wish to opt-out of having your home featured, please notify us in writing and send an email to alelegance@gmail.com before the project begins.
9. Privacy We collect personal information (name, address, contact details) solely for the purpose of providing renovation services. We do not sell your data to third parties. For full details, please refer to our Privacy Policy.
10. Dispute Resolution
● Good Faith Negotiation: In the event of a dispute, both parties agree to attempt to resolve the issue through good faith negotiation for at least 30 days.
● Mediation: If negotiation fails, the parties agree to submit to non-binding mediation in Vaughan, Ontario, before pursuing litigation.
● Governing Law: These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada.
11. Termination We reserve the right to terminate services if the Client fails to make payments, breaches these Terms, or creates an unsafe working environment. Upon termination, the Client is responsible for all work completed and materials purchased up to the date of termination.
12. Entire Agreement These Terms, together with the specific Project Contract signed for your renovation, constitute the entire agreement between you and Alelegance. Terms of Service and other policies of Alelegance are subject to change at the discretion of Alelegance.
